The terms governing your access to and use of AllScan products, services, and related technology by Pharma AllScan Tech LLP.
These Terms and Conditions ("Terms") govern your access to and use of the AllScan mobile application, software, website, and related services provided by Pharma AllScan Tech LLP ("AllScan", "we", "our", or "us").
By accessing or using AllScan, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
AllScan is an enterprise-focused software solution used in pharmaceutical and healthcare supply-chain operations. The Service may allow users to capture images, scan barcodes or QR codes, and extract or process information such as medicine names, batch numbers, expiry dates, manufacturing dates, pricing information, and other packaging-related data.
AllScan is intended for use by authorized business users, including pharmaceutical distributors, warehouses, logistics operators, stockists, carrying and forwarding agents, and other enterprise users involved in pharmaceutical operations.
AllScan is not intended to provide medical advice, diagnosis, treatment, or patient care. Users must not rely on the Service as a substitute for professional medical, regulatory, pharmaceutical, or legal judgment.
You may use the Service only if you are authorized by your organization or otherwise legally permitted to do so. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your account or authorized device access.
AllScan may use camera input, OCR, machine learning, rules-based logic, and related technologies. These technologies are helpful operational tools but may not always be complete, accurate, or error-free.
You acknowledge that scan results, extracted values, product identification, anomaly detection, and related outputs must be reviewed and validated before being used for dispatch, compliance, inventory, reconciliation, anti-counterfeit review, financial decisions, or any other operational purpose.
As between you and AllScan, you or your organization remain responsible for the legality, accuracy, quality, integrity, and authorized use of data submitted to or processed through the Service, including images, product information, transaction records, and integration data.
You represent that you have all rights, permissions, and authority necessary to use such data with the Service.
Your use of the Service is also subject to our Privacy Policy. Please review the Privacy Policy to understand how data is collected, used, processed, and protected.
You agree not to:
AllScan, including its software, models, workflows, design, branding, documentation, and related technology, is owned by Pharma AllScan Tech LLP or its licensors and is protected by applicable intellectual property laws.
These Terms do not transfer any ownership rights to you except for the limited right to use the Service in accordance with these Terms and any applicable commercial agreement.
The Service may interoperate with third-party systems, including ERP systems, cloud services, camera hardware, storage services, or other enterprise tools. We are not responsible for the availability, accuracy, security, or performance of third-party services or products.
We may modify, update, suspend, or discontinue any part of the Service at any time. While we aim to provide a reliable Service, we do not guarantee uninterrupted or error-free operation.
We may suspend or terminate access to the Service if we reasonably believe there has been misuse, unauthorized access, security risk, non-payment under a commercial agreement, or violation of these Terms.
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. AllScan disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy.
To the maximum extent permitted by law, Pharma AllScan Tech LLP and its affiliates, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings arising out of or related to the use of, or inability to use, the Service.
This includes, without limitation, losses arising from scanning errors, OCR errors, product misidentification, incorrect data extraction, operational decisions, supply-chain disruptions, counterfeit detection outcomes, or reliance on Service outputs without independent verification.
You agree to defend, indemnify, and hold harmless Pharma AllScan Tech LLP and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising from your misuse of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.
These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, courts having jurisdiction in Kolkata, West Bengal, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
We may update these Terms from time to time. The updated version will be effective when posted. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms.
